1. Who we are

These Terms of Service (“Terms”) apply to the website at forgedvials.com (the “Site”) and to every order placed through it. The Site is operated by ForgedVials Research LLC, a Missouri limited liability company (“ForgedVials,” “we,” “us,” or “our”).

ForgedVials Research LLC sells research materials only. No medical advice. No dosing guidance. No outcome claims.

2. How you accept these Terms

At checkout. Before you can place an order, you must check a required box (it is not pre-checked) confirming that you agree to these Terms of Service, our Refund Policy (all sales final except as stated), and our Shipping Policy, and that you have read our Privacy Policy. Each of these documents is linked next to the box. You cannot complete an order without checking it.

What we record. When you check the box and place your order, we log the version and effective date of these Terms, the date and time, your IP address, and your order number. We keep this record with your order (see our Privacy Policy).

Browsing. By using the Site, you also agree to follow these Terms while you use it.

If these Terms and one of those policies conflict on a specific point, these Terms control.

If you do not agree, do not use the Site or place an order.

3. Eligibility

To use the Site or buy from us, you must:

• Be at least 21 years of age. You must be 21 or older to access the Site and to purchase.
• Be a qualified researcher, or be purchasing for a research organization. You represent that the materials will be handled only by persons trained in laboratory procedures.
• Be purchasing for Research Use Only · Not For Human/Veterinary Use (see Section 4).
• Have a shipping address in the contiguous United States (48 states and Washington, DC). See Section 8 and our Geographic Restrictions page.
• Be able to enter into a binding contract.

We reserve the right to verify purchaser eligibility and to cancel orders that do not meet age, geographic, or research-use requirements.

4. Research Use Only · Not For Human/Veterinary Use

All materials sold by ForgedVials are sold strictly for laboratory research use.

• Our materials are Research Use Only · Not For Human/Veterinary Use, and are not for consumption, clinical use, diagnosis, treatment, or any therapeutic purpose.
• Our materials are not drugs, foods, dietary supplements, cosmetics, or medical products, and must not be used or represented as any of these.
• We do not provide medical advice, dosing guidance, or outcome claims, and nothing on the Site should be read that way.

RUO attestation at checkout. Every order also requires you to check a required box confirming the following:

By checking this box, I confirm that: (1) I am at least 21 years of age. (2) I am purchasing these materials for Research Use Only · Not For Human/Veterinary Use. They are not intended for consumption, clinical use, diagnosis, treatment, or any therapeutic purpose. I will not use or represent them as drugs, supplements, or medical products.

Refusal and cancellation. We may refuse or cancel any order, at any time before shipment, if we believe it suggests use outside of research, for example messages, order notes, or purchaser details that reference human or animal use, dosing, or therapeutic results. We may also decline future orders from the same purchaser. If we cancel an order, we refund any amount you paid for it.

5. Your responsibilities as the buyer

By purchasing, you agree that:

• You are solely responsible for how you handle, store, use, and dispose of the materials after delivery.
• You will handle the materials only in an appropriate research setting, by or under the supervision of persons trained in laboratory procedures.
• You will follow all federal, state, and local laws and regulations that apply to your purchase, possession, use, and disposal of the materials.
• You will not resell, relabel, or redistribute the materials for any use other than research, or represent them as fit for human or animal use.
• You will not export the materials or send them outside the United States (see Section 8).

Indemnity. To the extent the law allows, you agree to defend, indemnify, and hold harmless ForgedVials Research LLC and its owner, members, managers, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your misuse of any material, including any use outside of research; (b) your breach of these Terms or your RUO attestation; or (c) your violation of any law or the rights of any third party. This does not apply to the extent a claim is caused by our own negligence or willful misconduct.

6. Orders, pricing, and errors

• Order acceptance. Placing an order is an offer to buy. An order is accepted when we ship it. An automatic order confirmation email only confirms that we received your order; it is not acceptance.
• Pricing. All prices are in U.S. dollars (USD) and may change at any time before you place your order. The price that applies is the price shown at checkout when you place the order.
• Errors. We try to keep product listings, prices, and availability accurate. If we discover an error in a price, description, or availability, we may cancel the affected order (or the affected item) and refund any amount you paid for it, even after we sent a confirmation email.
• Availability. Materials are offered while supplies last. If an item is unavailable after you order, we will tell you and refund the unavailable item.
• Order review. We may review any order before shipment and may limit or cancel orders at our discretion, including for the reasons in Sections 3 and 4.
• Order quantity limit. Orders are limited to 20 vials total, across all products. Contact us at contact@forgedvials.com for larger orders, which we review case by case.
• Taxes. We collect applicable sales and use tax. Any tax is shown at checkout.
• Checkout details. Orders are placed as a guest; the Site does not offer customer accounts. A phone number is required at checkout so we and the carrier can contact you about your shipment and delivery.

7. Payment

• Methods. Available payment methods are shown at checkout and may change.
• Processors. Payments are handled by third-party payment processors or banks. We do not store full card or bank account numbers on the Site. Your use of a payment method may also be subject to that provider’s terms.
• No surcharges. We do not add a surcharge for paying by card.
• Payment first. Your order will not ship until payment is received and cleared.
• Failed payments. If a payment is declined, returned, reversed, or not completed, the order is cancelled.
• Pay by bank. If you pay by bank transfer / pay-by-bank, you authorize a one-time electronic debit from your bank account for the order total.
• Zelle. If you pay by Zelle, put only your order number in the memo. Zelle transfers cannot be reversed by us. Any refund we owe on a Zelle payment will be sent by Zelle to the account that sent it.
• Refunds. Other refunds go back to the original payment method.
• Payment disputes and chargebacks. If you have a problem with an order, please contact us first at contact@forgedvials.com; we aim to reply the same business day and can usually resolve issues faster than a bank dispute. If you file a dispute or chargeback, we will provide our order, payment, tracking, delivery, and checkout attestation records to the payment processor or bank. We may decline future orders after a dispute.

8. Shipping and risk of loss

Full details are on our Shipping Policy and Geographic Restrictions pages. In summary:

• Service area. We ship to the contiguous United States (48 states and Washington, DC) only. We do not ship to international addresses, Alaska, Hawaii, U.S. territories, PO Boxes, APO / FPO addresses, or freight forwarders. Orders with disallowed shipping addresses will be cancelled and refunded.
• U.S. only; no export. Materials are sold for use in the United States only and may not be exported.
• Rate and carrier. Shipping is a flat $20 via USPS Priority Mail, unless you choose local hand delivery.
• Local hand delivery (optional). At checkout you may choose local hand delivery, with no shipping charge. We deliver these orders ourselves. After you order, we will confirm whether your address is within our delivery area and contact you by phone or email to arrange a delivery time. The next-business-day processing time below does not apply; when we confirm, we will give you an expected delivery date, and the Delays terms below apply to that date. If your address is outside our area, we will cancel the order and refund the full amount you paid. Payment must be received and cleared before delivery; we do not accept payment at the door. Only the purchaser named on the order may receive it, in person, and must show valid government-issued photo ID showing they are 21 or older. We do not hand orders to anyone else and do not leave hand-delivered orders unattended.
• Hand delivery terms. For a local hand delivery order, the order ships, and is “Delivered” for purposes of these Terms and our policies, when we hand it to you, the purchaser, in person at the delivery address. Our handoff record (date, time, purchaser’s name, confirmation that ID was checked, and a photo of the package at handoff) serves as delivery confirmation in place of USPS tracking. Risk of loss passes to you at handoff. If you are not available with valid ID, or the order is refused, we will contact you to reschedule, up to 2 more attempts. If we still cannot complete delivery, we will cancel the order and refund the full amount you paid, with no fee. USPS-specific terms below, such as signature confirmation, tracking scans, carrier claims, and carrier holds, do not apply to hand-delivered orders.
• Processing. Orders ship the business day after payment is received and cleared, Monday–Friday. Orders received after the 5 PM CT cutoff count as received on the next business day. Transit times are estimates only and are not guarantees.
• Delays. If we cannot ship your order within the time stated, we will notify you of the delay and give you the option to cancel. If you cancel, we will refund you promptly, as the law requires.
• One shipment per order. We ship each order in one package when possible. If we split an order into more than one package, you are charged only once, at checkout, and pay no extra shipping.
• Tracking and emails. You will receive automatic order and tracking emails.
• Signature confirmation. USPS orders over $250 ship with signature confirmation.
• Insurance. We do not offer additional purchased insurance beyond the carrier’s included coverage.
• Risk of loss. Risk of loss passes to you when USPS tracking shows the package Delivered to the shipping address you provided. Please make sure your address is complete and correct; we are not responsible for packages delivered to an incorrect address you entered.
• Refused, unclaimed, or returned to sender. If a package is refused at delivery, left unclaimed, or returned to sender, we will refund the price of the materials minus the shipping charge after the package is returned to us. We do not reship these orders.
• Packages we are not responsible for. We are not responsible for orders sent to a disallowed address type that was not disclosed at checkout, or for packages affected by redirects or holds you request with USPS (for example, Package Intercept or Hold for Pickup).
• No scan. If the shipment has no tracking scan for 3 business days, we open a USPS claim. Resolution is case-by-case.
• Delivered, not received. Risk of loss has passed once tracking shows Delivered. If you did not receive the package, wait 3 days after the Delivered scan, then contact us. We review these case-by-case.

9. No returns; damage and fulfillment issues

Full details are on our Refund Policy page. In summary:

• All sales are final. We do not accept returns. We do not issue refunds or exchanges for shipped orders, except as described below. Opened vials or packaging are non-returnable.
• Pre-shipment cancellation. Orders cancelled before shipment receive a full refund.
• Damage and wrong-item reporting window. Report transit damage or a wrong item within 3 days after tracking shows Delivered.
• What to send for damage or a wrong item. Email contact@forgedvials.com with your order number and photos of the outer box, the inner packaging, and the vial(s) as received. Keep the material until we confirm next steps. If we ask, send a photo showing disposal of the affected material. Damaged goods are not returned to us.
• Transit damage. The shipment arrived damaged. Where accepted, resolution is a reship of the affected item only.
• Wrong item. You received a different research material than the one ordered. Resolution is a reship of the correct item, or case-by-case review if a reship is not possible.
• Material nonconformity. The lot materially does not match the published specifications or Certificate of Analysis (COA) for that batch. There is no fixed reporting window, because testing can take time. Contact us promptly at contact@forgedvials.com with your order number, the lot ID, and your test documentation. We review these claims case-by-case. Resolution is described in Section 11 (Limited warranty).
• Not covered.
  • Change of mind, unused product kept sealed, or dissatisfaction with research outcomes.
  • Claims that imply human use, dosing, or therapeutic results. Our materials are Research Use Only · Not For Human/Veterinary Use.
  • Damage or wrong-item reports made after the 3-day window.
  • Refunds or replacements for shipped orders outside the review paths above.

We aim to reply to every report the same business day.

10. Product information and Certificates of Analysis

• Product pages list information such as strength / net contents, form, purity, identity, and lot ID, based on supplier and independent third-party testing documentation.
• A Certificate of Analysis (COA) is on file for each lot. We will email the COA for your lot on request.
• Test results apply to the lot tested. Product information is provided for identification and research reference only. It is not a statement that any material is safe or suitable for any particular use, and it is not medical advice.
• We do not guarantee experimental outcomes.
• Product images may be for illustration and may not show the exact vial, label, or lot you receive. The vial label controls for lot ID.
• The Site does not host product reviews or customer testimonials.

11. Limited warranty

We warrant that each lot, at the time of shipment, conforms to the identity and purity shown on that lot’s COA.

If you believe a lot does not conform, contact us promptly with your test documentation, as described in Section 9. We review these claims case-by-case.

If we confirm that a lot does not conform, your sole and exclusive remedy is a reship of a conforming lot. If a reship is not possible, we will refund the price you paid for the affected item.

This limited warranty is the only warranty we give. It does not cover handling, storage, or use after delivery.

12. Disclaimer of warranties

13. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for personal injury caused by our negligence. Some jurisdictions do not allow certain limits on liability, so some of these limits may not apply to you.

14. Intellectual property

The Site and its content, including the ForgedVials name, logo, text, graphics, product sheets, and page layout, are owned by or licensed to ForgedVials Research LLC and are protected by law. You may view and print Site pages for your own reference in connection with your orders. You may not copy, reproduce, modify, or use our name, logo, or content for any commercial purpose without our written permission.

15. Prohibited uses

You agree not to:

• Buy or use any material outside Research Use Only · Not For Human/Veterinary Use, or for consumption, clinical use, diagnosis, treatment, or any therapeutic purpose.
• Give false information, including about your age, identity, research purpose, or shipping address.
• Send or submit content to us that requests or describes dosing, human use, or therapeutic results.
• Resell or represent any material as a drug, food, supplement, cosmetic, or medical product.
• Export any material outside the United States.
• Use the Site in violation of any law, or to infringe anyone’s rights.
• Interfere with the Site’s operation or security, including by scraping, using bots, introducing malware, or trying to access systems you are not authorized to access.

16. Termination

We may end your access to the Site or decline future orders at any time if you break these Terms or if we reasonably believe your purchases are not for research use. Sections 4, 5, and 9 through 20 continue to apply after termination.

17. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new version number and effective date. Changes apply to orders placed after the update is posted. The version you agreed to at checkout applies to that order.

18. Disputes, governing law, and venue

• Talk to us first. Before filing any claim, you agree to email us at contact@forgedvials.com with a description of the issue and your order number, and give us 30 days to try to resolve it informally. We agree to do the same before filing a claim against you.
• Governing law. These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules.
• Venue. If the issue is not resolved within 30 days, any legal action related to these Terms, the Site, or any order must be brought in the Missouri state courts located in St. Charles County, Missouri, and you and we consent to the jurisdiction of those courts.
• Small claims. Either of us may bring a claim in small claims court instead, if the claim qualifies.

19. General

• Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part will be enforced to the greatest extent allowed.
• No waiver. If we do not enforce a provision right away, we have not given up our right to enforce it later.
• Entire agreement. These Terms, together with the policies listed in Section 2, are the entire agreement between you and ForgedVials about the Site and your orders.
• Assignment. You may not transfer your rights under these Terms without our written consent. We may assign our rights to a successor business.
• Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control, including carrier delays, weather, and service outages.
